dc.description.abstractإن المقاصد الشرعية سواء كانت جلبا للمصلحة أو درء للمفسدة، يتوصل إليها بامتثال أوامر الشرع واجتناب نواهيه، والمأمور به لا يتوصل إليه إلا بالوسائل، فكل ما يصدر عن المكلف من أفعال فهي إما وسائل أو مقاصد، ولهذا كان باب القواعد المقاصدية المتعلقة بفقه وأحكام الوسائل مهم للاجتهاد المقاصدي. وتعالج الدراسة إشكالية اجتهادية تتعلق بنوازل العمل الخيري المختلفة، ويعتبر مجال العمل التطوعي والإنساني ومؤسساته من ميادين الواقع الغنية بالنوازل والقضايا المستجدة والتي تحتاج لاجتهاد متجدد ومرتبط بالمقاصد وملتزم بالشريعة مما يشكل حالة من ترشيد للعمل الخيري وتصحيح ممارساته. وكانت قواعد الوسائل مهمة للنظر الاجتهادي سواء في بيان حُكم الوسيلة مثل: للوسائل أحكام المقاصد، يغتفر في الوسائل مالا يغتفر في المقاصد، قد تكون وسيلة المحرم غير محرمة إذا أفضت لمصلحة راجحة. أو قواعد الوسائل في بيان رتبها وأثرها على المسائل والنوازل الفقهية مثل: قاعدة تختلف رتب الوسائل باختلاف قوة أدائها إلى المفاسد، وقاعدة الوسيلة إلى أفضل المقاصد هي أفضل الوسائل. Shariah objectives, whether aiming at warding off harms or bringing benefits, can be achieved by obeying the commands of Shariah and abandoning its prohibitions. What Allah ordered us to do cannot be reached without means, so all deeds of a legally commissioned person are means or objectives. Therefore, the field of Maqasid principles that are related to jurisprudence and rules of means is essential for Ijtihad in Maqasid. This study addresses an Ijtihad issue that is related to different juristic Nawazil and Novelties in charitable, voluntary, humanitarian and relief work. Since charity work has always novelties and emerging issues, it requires renewable Ijtihad that is connected to Maqasid and committed to Shariah rules, and thereby charity deeds can be effective and rationalized locally and internationally. The maxims of means are crucial for Ijtihad quoting whether in stating the rule of a mean such as: ‘’what can be excused in the means cannot be too in the ends’’ and ‘’the mean of a prohibited may not be prohibited if it leads to a significant public interest’’. Or in stating the rank power of the means rules and its impact on novelties and juristic cases such as: ‘’ the rank power of means depends on its ability to cause harms’’ and ‘’ the mean that leads to better maqasid is the best mean’’.en_US
