المصالح المرسلة عند المالكية

Abstract

الحمد لله وحده، والصلاة والسلام على من لا نبي بعده. وبعد: فهذا بحث المصلحة المرسلة عند المالكية دراسة تطبيقية معاصرة وهي كطريق من طرق الوصول إلى الأحكام الشرعية للحوادث الفروعية الفقهية. هدفه بيان القيمة التشريعية للمصلحة المرسلة في المذهب المالكيّ ،و تحديد الضوابط الحاكمة لها حتى لا يفضي التوسع فيه إلى القول في دين الله بالرأيّ المجرد والهوى والتشهي وقد جاء في ثلاثة مباحث: تطرقت في المبحث الأول إلى بيان معنى وحقيقة المصلحة المرسلة وأهميتها ثم أقسامها ، ثم علاقتها ببعض المصطلحات والفرق بينها وبين البدعة ، أما المبحث الثاني تناولت فيه حجيتها عند المالكية وضوابطها ومجال إعمالها ، أما المبحث الثالث فقمت فيه بعرض أربع مسائل تطبيقية للمصلحة المرسلة ، بدء بالبنوك والصيرفة الإسلامية ثم مرورا بحق التأليف ، فبراءة الاختراع ، وانتهاء بقانون السير والسلامة المرورية . وخلص إلى جملة من النتائج، من أهمها: إن المصلحة المرسلة لا تؤخذ إلا إذا ضبطت بضوابط الشرع، حتى تحفظ من تحريف الغالين وانتحال المبطلين وتأويل الجاهلين ، وأنه أينما وجد الشرع فثمّة مصلحة . وصلى الله وسلم على نبينا محمد وآله وصحبه، وسلّم.
