Abstract

الحمػػػػػد لله, كصػػػػػمى الله عمػػػػػى محمػػػػػد كآلػػػػػو كصػػػػػحبو كسػػػػػم . أمػػػػػا بعػػػػػد: ففي ىذه المذكرة تناكلنا مكضكع مدل حؿ العصمة الزكجية بالطلاؽ المعمؽ كىك ترتيب كقػكع الطلاؽ عمى حصكؿ أمر في المستقبؿ, كقد اختمؼ فيو الفقيػاء عمػى ثػلاث أقػكاؿ فاسػتقر بنػا المقػا مػف أقػكاؿ العممػاء إلػى أف الطػلاؽ المعمػؽ يتكقػؼ عمػى قصػد المعمػؽ كا ا ردتػو فػ ف كػاف غرضػو الحمػؿ عمػى فعػؿ الشػيء أك تركػو, كىػك يكػره كقػكع الطػلاؽ كلا غػرض لػو فػي إيقاعػو فيككف في معنى اليميف كلا يقع بو الطلاؽ كاف كػاف غرضػو حصػكؿ الطػلاؽ كقػع. فقػد قسػمنا البحػث إلػى ثػلاث مباحػث أساسػية : مبحػث تناكلنػا فيػو مفيػك العصػمة الزكجيػة أمػا المبحػث الثاني فخصصناه إلى حقيقة الطلاؽ كأما المبحث الأخير فجعمناه في حقيقة الطلاؽ المعمؽ. After: In this research we dealt with the subject of will by solving the foolproof conjugal, divorce commentator and divorce agreement in the future. Scholars have differed on three statements, they settled us on a primarily scholarly opinion that divorce depends on the intention of the commentator and his will, whether to divorce or not. If his intention is not to do it, that it shall not count as a divorce, and if his purpose was to get the divorce he will get it, this research has been divided into three basic sections: the study in which we dealt with the concept of foolproof conjugal, The second was to understand the divorce itself, and the last section was about the fact of the divorce. .
