النوازل الفقهية المالية من خلال كتاب البيوع من نوازل ابن الأعمش العلوي المالكي ت1107ه - دراسة وصفية تحليلية

Abstract

"الحمد لله والصلاة على رسول الله وبعد: فقد أثبتت الشريعة الإسلامية صلاحيتها لكل زمان ومكان، لثبوتها وحفظها بحفظ الله، مع مرونتها وشمولها، وقد برز جانب من جوانبها المتمثل بالنوازل الفقهية، والتي تعرف بأنها: "" ما استدعى حكمًا شرعيًا من الوقائع المستجدة "" ولهذا الموضوع الذي هو قيد الدراسة، أهمية عظيمة من الناحية الاجتهادية، وهذه من الأسباب التي دفعتنا لهذا الموضوع، بالإضافة إلى مكانة نوازل ابن الأعمش ، خاصّة ما يتعلق بالمالية منها. وقد استطاع فقهاء المالكية من خلال نوازلهم، التي اتسمت بالواقعية والمحلية، والتجدد المستمر وتنوع التأليف، أن يمزجوها بأدلتهم الاجتهادية، باستعمال قواعد الاستحسان وسد الذرائع...الخ ولهذه النوازل طرق تسلك لتتمّ الاستفادة منها، كالدراسة النصّية التحليلية لها، أو البحث عن القواعد والضوابط فيها، أو البحث عن النوازل المشابهة للقضايا المعاصرة، ... . وقد ركزنا في الجانب التطبيقي على نوازل البيوع واخترنا منها ما كان فيه خدمة لهذه الرسالة، ( السلم الحالّ، بيع البراءة، ...الخ ) وحاولنا إبراز الأدلة الاجتهادية، وإبراز الطرق التي يمكـن من خلالها الإستفادة. وأنهينا العمل بخاتمة وتوصيات، وفهارس تبيّن مضمون الرسالة، والله أعلم.""Praise be to God and blessings upon the Messenger of God and after The Islamic Sharia has proven its validity for every time and place, because it is proven and preserved with the protection of God, with its flexibility and comprehensiveness, and one of its aspects has emerged represented by jurisprudential calamities, which are known as: “the incident that requires a legal ruling” and for this topic that is under study, great importance from the point of view Jurisprudence, and this is one of the reasons that prompted us to this topic, in addition to the status of Ibn Al-Amash’s calamities, especially those related to finance. through their calamities, which were characterized by realism, locality, continuous renewal and diversity of authorship, the Maliki jurists were able to combine them with their jurisprudential evidence, using the rules of approval and blocking pretexts...etc. These calamities have ways to take advantage of them, such as the analytical textual study of them, or the search for rules and controls in them, or the search for calamities similar to contemporary issues, ... . In the practical aspect, we focused on the calamities of sales and chose from them what served this message (the current peace, the sale of innocence, etc.) and we tried to highlight the jurisprudential evidence, and to highlight the ways in which it can be used.
