Abstract

" عالجت هذه الدراسة الموسومة ب: موقع قاعدة ""الفتوى تتغير بتغير الزمان والمكان والحال"" في السياسة الشرعية وتطبيقاتها المعاصرة، وكان الاشكال الرئيس الذي تسعى للإجابة عليه هو: ما موقع قاعدة ""الفتوى تتغير بتغير الزمان والمكان والأحوال"" في السياسة الشرعية عموما، وتطبيقاتها المعاصرة خصوصا؟ ومن خلال مباحث ثلاث توصلت الدراسة إلى جملة من النتائج، أهمها أن هذه القاعدة طُبقت منذ زمن النبوة، ثم في زمن الصحابة ومن بعدهم، ولا يمكن الاستغناء عنها، وأنها من أهم القواعد التي يعتمد عليها في الاجتهاد المعاصر وخاصّة السياسي منه.
