القيود الواردة على سلطة رئيس الجمهورية في اعلان ورفع حالة الطوارئ في الجزائر

Abstract

انطلاقا لما يحوزه هذا الموضوع من أهمية بالغة لتعلقه بسلطات رئيس الجمهورية في إعلان حالة الطوارئ من جهة ، ولارتباطه بحقوق وحريات الأفراد المكفولة بموجب المواثيق الدولية و أحكام الدستور التي تحضر كل أنواع الممارسات التي من شانها تقييد ها أو مساس بها من جهة أخرى ،غير أن عدم مراعاة ذلك في ظل الظروف الاستثنائية وبالخصوص في حالة الطوارئ التي يتاح فيها لسلطة التنفيذية السلطة التقديرية الواسعة في اتخاذ كل ما يلزم من تدابير و إجراءات ولو على حساب اختصاص غيرها من السلطات ، تحت ذريعة حماية النظام العام و بالتالي تبجيله على حقوق وحريات الأفراد ، و بالأخص في ظل غياب ضوابط قانونية ملزمة تضمن حماية فعلية لها كما فعلت بعض التشريعات المقارنة ما يجعلها عرضة لتعدي والانتهاك ، ما يفرض ضرورة إعادة النظر في الأمر بوضع ضوابط كفيلة لتحقيق الهدف المنشود بحماية الحريات و تحقيق التوازن بينها وبين السلطة . from the great importance of this subject through hits attachment to the powers of the Presidents of the Republic with regard to the declaration of the state of emergency on the one hand, and its connection with the rights and liberties of individuals guaranteed by the international charters and the provisions of the constitution which prohibit all practices that limit or touch them, but the non consideration of this in exceptional circumstances and especially the case of emergency in which the executive power gives itself the power to take all measures and procedures, even if this is to the detriment of other powers under the pretext of preserving and glorifying the general order against the rights and liberties of individuals, especially in the absence of control obligatory legal systems which provide real protection, as some similar legislations has done, puts them in danger and makes them an object of violation, so it is necessity to review this case and to put effective constraints on achieving the desired object to protecting liberties and achieving a balance between them and the power.
