Abstract

ت بتعريف الزواج السري 􀇾 هجا، حيث بدأنا في 􀇼 ا م 􀇼 المالكي- وعرف المجتمع السوفي، وقد اتبع وآراء علماء 􀇾 ا حكم 􀇼 أربعة صور ثم بي 􀇾 وبين الزواج العرفي وزواج المسيار، وذكرنا ل 􀇾􀇼 والفرق بي القانونية 􀇽 ا بآثار 􀇼 وختم 􀇾 ا الحاضر، ثم عددنا أسباب 􀇼 في وقت 􀇾 ا لمفهوم 􀇼 ، وتطرق 􀇾 وادي سوف حول فسية سواء على المرأة أو الرجل، الأطفال أو المجتمع ككل. 􀇼 والاجتماعية وال ذا العقد 􀇿 يفسخ 􀇾 د المالكية لا يصح لأن 􀇼 ذا البحث أن زواج السر ع 􀇿 ا من 􀇼 وقد استخلص ويفرق بين الزوجين. Abstract In our subject study, we had discussed an issue about the marriage of the secret in Islamic jurisprudence- specifically in the Maliki school- and in the custom of the Soufian society, and we had defined it in sense of distinguishing between the similar itens, we also touched on its concept in our time, then we have dealt with its couses and sealed its legal and military effects on women, men, children or sosiety as a whole we concluded that the ruling on marriage at the Maalikis was not valid because it was recommended that it be mute before the contract or at the time, also, that it did not have the requirement of publicity and advertesing, so this contract will be broken and as a result, it distinguishes between the spoues
