شهــــــادة الـــــــزور بين الشريعة الإسلامية والقانون الجزائري

Abstract

إنّ شـهادة الشـهود تلعـب دوراً فعّـالاً فـي إثبـات الحقیقـة وإیصـال الحقـوق إلـى أهلهـا، كمـا تعتبر دلیلاً هامّاً من أدلـة الإثبـات، لـذلك فـإنّ الشـریعة الإسـلامیة حرّمـت الكـذب فیهـا وحـذّرت من شهادة الزور، واعتبرتها من أكبـر الكبـائر، بحیـث سـاوت بینهـا وبـین الإشـراك بـاالله وعقـوق الوالدین، لذلك عاقبت عنهـا بعقوبـات تعزیریـة لمـا فیهـا مـن ظلـم وهضـم للحقـوق وذلـك محاولـة للردع عن ارتكابها والحدّ من تفشیها داخل المجتمعات الإسلامیة. كمـا جـاء قـانون العقوبـات الجزائـري علـى غـرار بـاقي القـوانین الوضـعیة بتجـریم شـهادة الـزور، وحـدّد لمرتكبهـا عقوبـات رادعـة بحسـب نـوع الجریمـة، فلكـلّ جریمـة عقوبـة خاصـة بهـا ســواء كانــت الجریمــة جنایــة أو جنحــة أو مخالفــة، وذلــك ردعًــا للجــاني ولغیــره عــن ارتكــاب جریمـة شـهادة زور، وذلـك لمـا فیهـا مـن إلحـاق الضـرر بـالآخرین، كمـا أعطـى القـانون الحـق للمضرور من شهادة الزور في الدفاع عن نفسـه وإرجـاع حقّـه الـذي سُـلب منـه بسـبب الشـهادة المكذوبة تحقیقًا منه للعدل وحفاظاً على استقرار المجتمعات. Abstract The certificate of witness plays an important role in evidence of truth and conveyance of rights to their possessors, as well as, it considers an essential proof of evidence of confirmation. Thus, the Islamic law Sharia forbade the lie and warned about perjury consider the latter as one of the biggest sins, it make it equal to the sin of polytheism and dis obedience of parent . Thus, Sharia punished the perpetrators with strong penalties because the perjury led to the injustice and loss of rights, the aim behind the enactement of these penalties is to prevent and reduce the perjury inside the Islamic communities. The Algerian law of punishement incriminated the perjury as the same others positive law and enact deterrent punishement for the perpetrators according to the type of crime, each crime has a particular punishement, whether it is felonp, offense or lereach, in order to deter the perpetrator and others from saying pejury because the latter harm the others . The law give also the right of deffense for the victim from pejury and to return his/her right that had lost due to the pejury for the justice and the stability of societies
