الضوابط الموضوعية لإجراء الدراسات الدوائية على البشر في القانون الأردني، دراسة تأصيلية

Abstract

تهدف هذه الدراسة إلى بيان مفهوم الدراسات الدوائية على البشر والأساس الشرعي لها. كما تتناول الضوابط الموضوعية لإجراء هذه الدراسات في قانون إجراء الدراسات الدوائية الأردني رقم 2 لسنة 2011م. ومن هذه الضوابط: الأهلية والعلم والاختيار، والتقيد بالإجراءات الطبية الكفيلة بضمان سلامة المتطوع الشخصية. ووجوب مراعاة القواعد الشرعية والأخلاقية والإنسانية والمهنية اللازمة لإجراء التجربة. كما تستعرض الدراسة العقوبة التي قررها القانون الأردني على من يخل بالضوابط المقررة لإجراء الدراسات الدوائية على البشر، وفي النهاية تختتم الدراسة بخاتمة تتضمن عدداً من النتائج والتوصيات. ABSTRACT The aim of this study is to explain the concept of medical studies on humans and their Shariah basis . It also handles the substantive controls for the conduct of these studies in the law of conducting Jordanian Medical studies No 2 of 2011 These controls are : * Capapility , feedback , selection and implementation by medical procedures that guarantee the safety of the personal volunteer. * Must obey the rules of Sharia and morality , human and professional rules that is necessary to conduct this experiment. Also the study reviews the penalty determined by Jordanian law on those who violate the controls set for conducting medical studies on humans. Finally the study concludes with a number of conclusions and recommendations.
