Abstract

"موضوع الدراسة هو الاحتكار وصوره المعاصرة دراسة تطبيقية لنماذج مختارة. واشكاليته الرئيسية هي: إلى أي مدى يمكن الأخذ بالمعايير الشرعية التي تضبط الصياغة الشرعية (التكييف الفقهي) المتحكمة في صور الاحتكار المعاصرة. وقد جاءت هذه الرسالة مشتملة على مقدمة ومبحثين وخاتمة أما المبحث الأول تناول التأصيل الشرعي للاحتكار وفيه تعريف الاحتكار وبيان حكمه وشروطه وذكر أنواعه وآثاره أما المبحث الثاني فقد اشتمل على نماذج تطبيقية لصور الاحتكار المعاصرة ومعرفة الوسائل الوقائية والعلاجية وخلص البحث إلى أن: الاحتكار ظاهرة اجتماعية واقتصادية خطيرة لما لها من آثار سلبية على الفرد والمجتمع إذ يعد جريمة من الجرائم القديمة الحديثة المضرة بحياة الناس كما أوصى البحث الدارسين وطلاب العلم بتوجيه الاهتمام بصور الاحتكار المعاصرة ودراسة كل صورة منه ببحث خاص تأصيلا وتطبيقا.
