أثر العرف في المعاملات المالية المعاصرة

Abstract

"تناولت الدراسة بعنوان: ""أثر العرف في المعاملات المالية عند المالكية ــ نماذج مختارة"" التي تتحدث عن مدى تأثير العرف في المعاملات المالية لدى المالكية، منطلقة من إشكالية رئيسية كانت كالآتي: ما مدى تأثير العرف في المعاملات المالية عند المالكية؟. وللإجابة على الإشكالية المذكورة أعلاه رسمتُ خطة قسمتها إلى مبحثين؛ في المبحث الأول كان مبحثاً نظرياً لبيان حقيقة العرف، وضوابطه، أما عن المبحث الثاني فكان تطبيقياً تطرقتُ فيه إلى ذكر بعض النماذج من عقود المعاوضات والتبرعات التي للعرف أثر فيها. توصلت الدراسة إلى نتائج أهمها: أن العرف أصل أصيل في المذهب المالكي وهم أحفل المذاهب وأوسعهم أخذاً به، ويتضح أثره الكبير في باب المعاملات المالية. The first topic was a theoretical study for showing the truth of the custom . which the second topic was applied to mention some of the models of contracts of negotiations and the contributions which the habit affected them. The study reached to the most important results: that the custom is an authentic origin in the Maliki doctrine and the widest to do it and its big role is clear in the financial transactions section "
