الحماية الجنائية لحق الطفل في الحياة في القانون الجزائري

Abstract

في إطار الحماية القانونية تبرز الحماية الجنائية لدورها الكبير في حماية الإنسان ورعاية حقوقه ومنها حقوق الطفل؛ وقد اهتم المشرع الجزائري في قانون العقوبات والنصوص ذات الصلة بهذه الفئة في نصوصه مكرسا حماية جنائية لحق الحياة من حقوقه معتبرا إياه إنسانا يستحق البقاء، فنص على تجريم أفعال لها أثرها في حياته دون أن ينص صراحة على تجريم انتهاك الحق في الحياة وهذا أهم ما خلصت إليه من خلال هذه الورقة. Abstract: Within the legal protection, Criminal protection shows its great role in protecting the human being and protecting his rights as well as the rights of the child. The Algerian legislator has paid attention to this category in the penal code, devoting criminal protection of the right to life from his rights, considering him a human being who deserves to survive; He criminalized actions that have an impact on his life, but without explicitly stipulating the criminalization of the violation of the right to life, and this is the most important conclusion I have concluded through this paper.
