أحكام زواج مجهول النسب -دراسة فقهية مقارنة-

Abstract

"ملخص البحث: تَكْمُنُ أهمية قضية مجهولي النَّسب في معرفة الأمور والقضايا التي تتعلَّق بهم، والتي من بينها قضية الزَّواج؛ لذا فإنَّ بحثنا هذا الموسوم بــــــ: ""أحكام زواج مجهول النَّسب -دراسة فقهيَّة مقارنة-، يسعى للإجابة عن الإشكالية الآتية: ما هي أحكام زواج مجهول النَّسب في الشريعة الإسلامية؟ وقد حاولت هذه الدِّراسة الإجابة عنها مِنْ خلال مبحثين. تطرَّقْنَا في المبحث الأول إلى مفهوم مجهول النَّسب وموقف الإسلام والقانون الجزائري منه، وأمَّا المبحث الثاني فقد بيَّنا فيه حكم زواج مجهول النَّسب في الفقه الإسلامي. وتوصلت الدِّراسة إلى جُملةٍ مِنَ النتائج، لعلَّ مِنْ أبرزها: أنَّه لا مانع يحول دون زواج مجهولي النسب. وأنَّ العبرة في الزواج بالدين والخلق، لا الحسب والنسب. وخَلُصْنا في نهاية رسالتنا إلى عدَّة وصايا، لعل مِنْ أهمِّها: توسيع نطاق البحث في هذا الموضوع والتَّعمق في دراسته. كما نوصي أيضا بضرورة تيسير الدولة والمجتمع المدني لزواج مجهولي النسب؛ درءًا للمفاسد وصيانة لهم من الوقوع في براثن الرذيلة."Research Summary: The importance of the issue of people of unknown descent lies in knowing matters and issues related to them, including marriage; therefore, our research was entitled: ""Marriage Provisions of people of unknown descent - a comparative jurisprudence study which seeks to answer the following problem: What are the provisions of people of unknown descent in Sharia Islamic law? This study sought to answer this in two sections. In the first section, we discussed the concept of unknown descent and the position of Islam and the Algerian law. Moreover, in the second section, we have shown the Islamic jurisprudence provisions of unknown descent marriage. The study reaches to a set of results. The most prominent one is that there is no objection to marrying people of unknown descent. In addition, marriage relies on religion and ethics rather than noble lineage. We concluded that the most important recommendation is expanding the scope of research on this topic and delving deeper into its study. We also recommend that the state and civil society should facilitate the marriage of people of unknown descent in order to ward off vices.
