التشريع بأوامر في إطار التعديل الدستوري الجزائري لسنة 2016

Abstract

ملخص: لقد أصبحت السلطة التنفيذية تساهم و تنافس في الإنتاج القانوني عن طريق جملة من الآليات التي من أهمها التشريع بأوامر المخول لرئيس الجمهورية، والذي تطور بشكل واضح عبر التجربة الدستورية من التفويض إلى الاختصاص الأصيل. كما اختلفت ممارسة هذه الآلية حسب طبيعة الظرف، ففي الظروف العادية تمت إحاطتها بجملة من الشروط كغيبة البرلمان و الاستعجال، كما تم تقييدها بإجراءات محددة كاستشارة بعض الهيئات، أما في الظروف الاستثنائية فقد تم تخويل هذه السلطة لرئيس الجمهورية بشكل واسع كونه حامي الدستور و مجسد وحدة الأمة في حدود الحفاظ على الحقوق و الحريات المكفولة دستورا. كما لم يمنع ذلك من وجود رقابة على هذه الآلية كضمانة في مواجهتها، و التي تضيق و تتسع حسب طبيعة الظرف. Abstract: The executive authority has become a contributor to competition in legal production through a number of mechanisms, the most important of which is the legislation, under the orders of the president's authority, which has clearly evolved through the constitutional experience from the mandate to the original jurisdiction. The practice of this mechanism varied according to the nature of the circumstance. In normal circumstances, it was surrounded by a number of conditions, such as the absence of parliament and urgency. It was restricted by specific procedures such as consultation of some bodies. In exceptional circumstances, however, The nation within the limits of the preservation of rights and freedoms guaranteed constitution. This has not prevented the existence of control over this mechanism as a guarantee against it, which is narrowing and widening according to the nature of the circumstance.
