الترجيح في مؤلفات المالكية

Abstract

يبين البحث اهتمام المالكية بالترجيح في مؤلفاتهم، حيث برز علماء في المذهب كانت لهم قدرة على فهم النصوص والاستنباط منها، ومراعاة تغير الظروف والواقع والمصالح فكان لزاما أن يكون لكل مرحلة ما يليق بها من أحكام، لذلك تصدى علماء لهذا الأمر ورجحوا بين الأقوال المختلفة في المذهب بناء على قوة الدليل أو المصالح أو العرف وهي أهم قواعد الترجيح عند المالكية. This study demonstrates interesting of Maalikis by Tarjih in their compositions, where scientists emerged in the doctrine who have had the ability to understand the text, including the elicitation, taking into account changing of circumstances, reality and interests. Hence, it was necessary to be for each stage appropriate provisions. So scholars confronted to this matter, and they have studied the different opinions in the doctrine based on the strength of evidence, interests or custom which constitute the most important rules of Tarjih in Maaliki
