المسؤولية الجنائية بفعل المساهمة في الجريمة الجمركية

Abstract

يشكل خروج قانون الجمارك عن القواعد العامة خصوصية بارزة له، خاصة من ناحية تحديد المسؤولية الجزائية في المنازعة الجمركية، الامر الذي يظهر جليا من حيث تعدد المسؤولين قانونا والمساهمين بطريقة مباشرة في ارتكاب الجريمة الجمركية، وكذا المشاركين او المساهمين بطريقة غير مباشرة فيها. The deviation of the Customs Law from the general regulations is its distinct characteristic, particularly when it comes to determine penal responsibility in the customs disputes. This becomes evident due to the plurality of legal Customs authorities and to those who, directly or indirectly, contribute to the Customs offence.
