Abstract

يظهر اهتمام الأصوليّين بتفســـــــــــــــــــــير النّصوص الشّرعية من خلال اجتهادهم في وضع ضوابط تحكم هذا التّفســــــــــــــير، حيث اعتنوا باستخــــــــــــــــلاص الأحكام الموجّهة إلى المكلّفين بــها، فكانت القرينة الأصوليّة إحدى هـــــــــــذه الضّوابط، وانطلاقا مما سبق نتساءل: ما الـــــــــــــدّور الذّي أدّته القرائن في ترجيح الخطاب الشّرعي؟ وللإجابة عن هذا السّؤال اتبعنا المنهج الوصفي بآلية التحليل، وقد توصلنا في بحثنا هذا إلى نتائج منها: للقرينة دور في التّرجيح بين دلالات الألفاظ الشّرعية. The interest of Fundamentalists about the interpretation of legal texts appears in the diligence to implement controls to lead this interpretation. They took care of extraction of provisions for those charged of them. Therefore, the Fundamental indication is one of those controls. What is the role of Fundamental indication to make the preference of legal speech? To answer, I follow the descriptive analytical method.
