Abstract

"حدود سلطة الولي على مال القاصر هي تلك التصرفات المالية التي تصدر من ولي القاصر على ماله، فتكون إما مقيدة لا تتم إلا بإذن من القضاء وذلك لعدم ثبوت المصلحة المراد توافرها للقاصر أو تكون مطلقة لثبوت وتحقيق المصلحة المستهدفة للقاصر. ويعد وضع هذه الحدود لسلطة الولي من أهم الضوابط التي تضبط الولي في تصرفاته على مال القاصر ذلك أنها تحقق الحماية اللازمة لهذه الأموال و الحيلولة دون إلحاق الضرر بها مما يؤدي إلى حفظ كل ما يؤول إلى ذمته المالية، وتكمن أهمية هذه الضوابط في الحرص على السير الحسن للتصرفات المبرمة من طرف الولي وحماية لمال المولى عليه مما قد يعتريه من نقائص أو انحرافات، وحتى لا يكون الولي في مرتبة الظلم والتعسف للقاصر وذلك بتجاوزه لحدود السلطة الممنوحة له على ماله . ولهذا فإن الأمر يتطلب من المشرع وضع حدود لهذه السلطة و إحاطتها بقيود وضمانات معينة لمباشرة بعض التصرفات والعقود التي ينصرف أثرها إلى القاصر وهذا ما اتبعه المشرع الجزائري والبعض من التشريعات العربية الأخرى، وما سبقت إليه الشريعة الإسلامية " Summary Note limits the authority of the guardian of the minor money are those financial dispositions issued from a minor to his money, either be constrained only by permission of the judicial process, for lack of interest to be made available to minors or be absolute for and target interests of the minor.
