إشراك الأطفال في النزاعات المسلحة بين الفقه الإسلامي والقانون الدولي الإنساني

Abstract

تعنى هذه الدراسة بموضوع " إشراك الأطفال في النزاعات المسلحة بين الفقه الإسلامي والقانون الدولي الإنساني " وهو من ابرز محاور اهتمامات المجتمع الإنساني إذ جاءت أحكام الفقه الإسلامي أكثر صلاحا مند خمسة عشر قرناً تنهى عن تجنيد الأطفال في القتال قبل بلوغ الخامسة عشرة ، وبذل المجتمع الدولي مجهوداً مقدرا وان كان متأخراً في هذا الشأن ، فتطرق الباحث لمفهوم الطفل والنزاعات المسلحة واستعرض مفهوم إشراك الأطفال في النزاعات المسلحة في نوعين : الأول : اعتبار الجهود المبذولة لمنع تجنيد الأطفال في الفقه الإسلامي والقانون الدولي الثاني : المركز القانوني للأطفال عند اشتراكهم في النزاع المسلح ، ليخلص في الأخير إلى نتائج واقتراحات أهمها : ضـــــــرورة التزام الدول بالمبادئ الإنسانية في الحد من إشراك الأطفال في النزاعات المسلحة لأنها اكبر انتهاك لحقهم في الحياة .This study deals with the issue of "Involving children in armed conflicts between Islamic jurisprudence and international humanitarian law". It is one of the main concerns of the humanitarian community. The Islamic jurisprudence has been more effective since the last fifteen years. It forbids the recruitment of children in combat before the age of 15. The researcher discussed the concept of children, armed conflicts and reviewed the concept of involving children in armed conflict in two ways: Firstly: The Considerable efforts that prevent the recruitment of children in Islamic jurisprudence and international law. Secondly: the legal status of children when they participate in armed conflict. Finally, it concludes with conclusions and recommendations, the most important of these are: The need for countries to abide by humanitarian principles in ending the involvement of children in armed conflicts because it is the greatest violation of their right in livin
