الشك وأحكامه عند المالكية من خلال كتاب ضوء الشموع على شرح المجموع للعلامة الأمير- كتابي الطهارة والصلاة أنموذجاً -

Abstract

البحث بعنوان "الشك وأحكامه عند المالكية من خلال كتاب ضوء الشموع على شرح المجموع للعلامة الأمير- كتابي الطهارة والصلاة أنموذجًا-" قسمنا هذا البحث إلى مقدمة، ومبحثين وخاتمة، فالمقدّمة؛ عناصرها معلومة، وبعدها جعلنا المبحث الأول لدراسة الشّك نظرياً؛ بحيث احتوى على ثلاث مطالب؛ الأول عرَّفنا فيه الشك ثم وضحنا الفرق بينه وبين ما شاكله من مصطلحات، والثاني ذكرنا فيه أقسام الشك وضوابطه، والثالث خصصناه لدراسة ترجمة الشيخ محمد الأمير وحجازي العدوي، ودراسة للكتاب، وأمّا المبحث الثاني جعلناهُ لدراسة أحكام الشك تطبيقيّا؛ حيث درسنا بعض مسائل الشك المستخرجة من كتاب "ضوء الشموع" كتابي الطَّهارة والصَّلاة أنموذجاً؛ ولقد أخذنا من كل كتاب أربعة مسائل فقهيّة، واستقل كل منهما بمطلب خاص، وفي الأخير تضمنت الخاتمة أهم النتائج والتوصيات. " The research entitled “Doubt and its rulings according to the Malikis through the book Candlelight on the Explanation of the Majmoo’ by Allamah Al-Amir - Books of Purification and Prayer as a Model-” We divided this research into an introduction ،two chapters and a conclusion, the introduction; elements are known, After that ، we made the first topic to study doubt theoretically؛ It contained three demands; In the first we defined doubt and then clarified the difference between it and similar terms ، the second we mentioned the sections of doubt and its controls ، and the third we devoted to the study of the translation of Sheikh Muhammad Al-Amir and Hijazi Al-Adawi . And a study of the book، and as for the second topic ، we made it a practical study of the provisions of doubt. Where we studied some issues of doubt extracted from the book ""Candlelight""، the two books of purity and prayer as a model ; We have taken from each book four issues of jurisprudence، and each of them was independent with a special request، and in the end the conclusion included the most important results and recommendations.
