البدعة الإضافية "أحكام وضوابط"

Abstract

الملخص: عالج هذا البحث أحكام وضوابط البدعة الإضافية من حيث كونها عملية، وقد تتبعت أراء العلماء في المسألة وتأصيل وجوه خروجها عن البدعية إلى وجوه المصالح المرسلة مع مراعاة باب ذريعة المتذرع إلى ذلك ومن خلال هذا النظر وقصد تحقيق هدف البحث المتمثل في إبراز جوانب البدعة الإضافية " أحكام وضوابط" بين اتجاه المثبتين لذلك والنافين له، فقد قسمت العمل إلى مبحث تمهيدي تمثل في بيان إطلاقات البدعة، المطلب الأول تمثل في الوضع اللغوي والاصطلاحي، والثاني فيما اشتملت عليه معاني القرآن الكريم والسنة النبوية. ومبحث تعرضت فيه لمفهوم البدعة الإضافية، مطلب تناولت فيه تعريفها وأقسامها، والثاني تمثل في أسبابها، والمطلب الثالث ضوابطها، أما عن المبحث الثاني فخصصته فيما تعلق بمسألة التأصيل الفقهي للبدعة الإضافية من بابي المصالح المرسلة، وسد الذرائع، ثم أفردت المبحث الثالث في بيان حـكـــــــــــم البدعــــــــــــــة الإضافية، من خلال مطلب تعلق بأقوال العلماء في المسألة، والآخر بذكر الأدلة مع المناقشة، والمطلب الأخير فيما جمع بين الأقوال والترجيح.

This study tackles the rules and regulations of the "additional heresy" as being practical. We have also tackled the scholars' statements concerning the issue and the rooting of its divergence from heresy into "the general good" with consideration to the subject of the pretext of the "pleaded". Through this prospective, and in order to achieve the aim of this study, namely highlighting the different aspects of the additional heresy, we investigated the topic among those who reject it and those who approve of it. This work is divided into an introductory part that demonstrates the release of heresy. The first section of this part tackles the linguistic and terminological situation while the second one targets the study of what the meaning of the Holy Quran and the prophetic Sunnah have to say about the subject of this study. Furthermore, in the first part of this study, we dealt with definition of the additional heresy and its divisions in a section, its causes in a second one, and its regulations in a third one. the second part of the study is devoted to the issue of the juristic rooting of the additional heresy with consideration to 'general good' and the 'prevention of means( to sins)'. Lastly, the third part is dedicated to the ruling of the additional heresy, with a section dealing with the scholars' statements concerning the issue , a second one tackling the evidence with discussion, and a third one combining statements with probability.
