قاعدة سد الذرائع وأثرها في المعاملات المصرفية الإسلامية " التورق المصرفي نموذجا"

Abstract

"تتناول هذه المذكرة موضوع قاعدة سد الذرائع وأثرها في المعاملات المصرفية الإسلامية "" التورق المصرفي أنموذجا"". وتمت معالجة هذا الموضوع وفق إشكالية رئيسية هي: ما مدى تأثير قاعدة سد الذرائع على التورق المصرفي؟ عُولجت هذه الإشكالية في ثلاث مباحث تناولنا في الأول: ماهية قاعدة سد الذرائع، وفي الثاني: ماهية المعاملات المصرفية الإسلامية، وخُصص المبحث الثالث لبيان أثر القاعدة الأصولية في عمليات التورق المصرفي. ومن أهم النتائج ما توصلنا إليها من خلال بحثنا هذا: أن العلاقة التي تربط بين سد الذرائع والمعاملات المصرفية الإسلامية هي علاقة ترابط وتكامل، فمن خلال قاعدة سد الذرائع نعرف المعاملات التي تؤدي إلى مفاسد فنعمل على سدها ومنعها. وفي الأخير نوصي: بدراسة هذا الموضوع دراسة موسعة لحاجة الناس إلى فهمه. "In this research we have studied the rule of bloching excuses and their imqact om Islamic banhing transaction sell and buy as a model. We have treated this topic according to main qroblem what is the imqact of the rule of bloching excuses and banhing sell and buy? Under three chaqters. The first chaqter was the definition of the ruleof bloching excuses. The second chaqter under the title of ""what is the Islamic banhing transaction. The thir chaqter was about the imqact of the fundament rule in banhing sell and buy. One of the most impotqnt resuls that we reached through this research: the relationship between the rule blocking pretexts and lslanic banking transactions is a relationship of integration and solidarity.
