Abstract

إن مستحدثات العصر وما صاحبه من تطور أوجدت لنا مفهوما جديدا للمال هو المال المعلوماتي، الذي وإن كان في شق منه مادي لا يطرح أي إشكال في حمايته بموجب النصوص المنظمة لجريمة السرقة، فإن شقه الثاني الذي يغلب عليه الطابع المعنوي والذي اصطلح على تسميته بالمعطيات المعلوماتية، أثار جدلا واسعا حول مدى إمكانية انطباق وصف المال المنقول المملوك للغير عليه، ومدى خضوعه لفعل الاختلاس، اللذين يستوجبهما قانون العقوبات لقيام الركن المادي في جريمة السرقة. Abstract: The time inovation and its acompanied evolution has created a new concept of money that is information money. Which its material side can be protected without any opsticles through the regulating notions of the crime of stealing, the other moral side , termed the informatics data, sparked a wide controversy on to what extent is the application of the transfered money owened by others is possible , and how far it is submissed to the act of embezzement. Which are required by the penety law to establish the physical element in the crime of stealing
