ضوابط العمل بالقول الضعيف عند المالكية من التنظير إلى التنزيل، وأثر ذلك على بعض المستجدات "الإجارة بالجزء نموذجا

Abstract

لقد ظلّ العمل بالقول الضعيف من المسائل الأصولية التي تتقاذفها الأمواج، ويكتنفها الغموض، وذاك لتردد كلام الفقهاء فيه بين رده والتحذير منه، وبين قبول العمل به، وإحصاء المسائل المخرجة عليه، مما شكّل لبسا عند المتقصي لأقوالهم ما لم يلاحظ تباين مورد الكلامين، لذلك خصصت هذه الدراسة لاستجلاء حقيقة ذلك، والتوفيق بين تلك الأقوال، من خلال بيان المراد منها، وحدّ الضرورة الملجئة إليه، ولكيلا يبقى الكلام نظريا جمعت بين الاستدلال بقواعد التأصيل، والاسترشاد بمواقع التنزيل، ثم حاولت استثمار ذلك في بعض مستجدات وقتنا الراهن، مسترشدا بما جمعت من المحلين. وقد توصلت إلى: أن القول الضعيف يعمل به إذا ألجأت إليه الضرورة، بل ويقدم على المشهور، كما تبينت أن حدّ الضرورة المبيحة للتعامل بالقول الضعيف كالإجارة بالجزء ما ينشأ عنها انقطاع المنفعة من المحلّ بالكلية، وألا يوجد سبيل آخر للاستفادة من ذلك الحقل إلا بهذه المعاملة، كما اشترطوا في المحلّ أن يكون ذانفع كبير، ومردود مادي زاخر، بحيث يُدخل تعطيله الضررَ على الجميع. Abstract : Using the weak say has been one of the most controversial and ambiguous topics in Islamic jurisprudence. This is mainly due to how jurists approach this issue. Some have warned against it or reject it while others have accepted it and listed the issues that the weak say can be applied to. These asymmetrical Fatwas led to a great deal of confusion for anyone who seeks to understand this topic. This study fills the gap in this area by diving deep into the previous research, comparing it, revealing its purpose, and determining the necessities that permit applying the weak say. This study uses both rooting standards and revelations as a guide and at the same time apply these findings to some of the contemporary issues in the world today. This enables the study to avoid being merely theoretical. The findings display that, the weak say can be used and even prioritized over well-known say if there is a necessity. The results also show that the limit of necessity that permits using a weak say in issues such as partial lease is that if it will lead to interruption of benefit to the whole store.
