ضوابط الفتوى في النوازل المعاصرة وصلتها بمنحى الضبط في أدوار الفقه الإسلامي

Abstract

يطرح هذا البحث إشكالية ضبط تغير الفتوى في النوازل المعاصرة، وكذا ضبط إعمال مقاصد الشريعة وأصولها، مع باقي الأدلة الجزئية في النظر الفقهي الصناعي في خصوص النوازل المعاصرة، وبيان صلة ذلك بمنحى الضبط عند الفقهاء والأصوليين في الأدوار التي مر بها الفقه الإسلامي. فإذا وقعت نازلة معينة، سياسية أو اقتصادية أو اجتماعية، تتعلق بالعبادات أو المعاملات، سواء تعلقت بحياة الأفراد أو الجماعات، فمن هو المؤهل شرعاً للانتصاب في البت في هذه النازلة ابتداء ؟ وما علاقة طبيعة النازلة وجغرافيتها الواقعية في تحديد الهيئة المخولة للبت فيها ؟ وقد خلص هذا البحث إلى جملة من النتائج أهمها: ضرورة إعادة تصنيف النوازل الحديثة تصنيفاً جديداً يستجيب لطبيعة العصر ويستجيب لخصوصية كل نازلة. Abstract : This research treated the problematic of adjusting fatwa changes in contemporary calamity, as well as adjusting the realisation of Shari'a objectives and its assists, with the rest of the partial evidences in jurisprudence view on contemporary calamity and its relation with fixing path of Fiqh and Usul scholars, through the different stages of Islamic jurisprudence. When a new social, economic or political calamity happens, even individual or collective, who is legally qualified to decide in this calamity? What is the relationship between the nature of the calamity and its real geography, in precising the designed mien to decide on it? This study concluded that it is necessary to reclassify the contemporary calamity going with the nature of our age, and the specificities of the calamity
