الاعتراف بالخصوصيات الثقافية ودورها في تفعيل عالمية حقوق الإنسان

Abstract

تعد من أهم خصائص حقوق الإنسان ميزتها بالعالمية، لأنها الضامن الأساسي لاحترام حقوق الإنسان لكل البشر في العالم، وهي تتداخل في بعض الحالات مع مفهوم عولمة وتدويل حقوق الإنسان بالرغم من اختلافهما، وتبدوا مبدئيا تتعارض مع الخصوصيات الثقافية للعديد من المجتمعات، لأنها لم تساهم بثقافتها في وضعها لعدة أسباب، وبالتالي تبقى حقوق الإنسان عالمية بالرغم من التعارض في بعض الحالات مع خصوصيات المجتمع، من جهة مادامت هناك حلول للتعايش، والمتمثلة أساسا في آلية التحفظ والاتفاقيات الإقليمية، ومن جهة أخرى لضرورة أخذ حقوق الإنسان كمفاهيم عامة عالمية قد تحمل في طياتها بعض الاختلافات التي ترقى إلى درجة المساس بميزة العالمية. Human rights are a great title of many and ramified details, they are specific in comparison with other law branches. The universality is one the most important character of human rights; it is the warrant of its application over the world. But it can be confused with other concepts as internationalization and globalization of human rights. The cultural characteristics of several societies out of Europe are in contradiction with the universality of human rights, they didn’t contribute in their first adoption, for many reasons. However these rights stay universal despite this formal opposition with certain cultural characteristics, as long as there are some solutions: the reservation mechanism and the regional treaties of human rights on one hand, and the admission that human rights can bear some differences besides the common rights
