الإستقلالية العضوية لخلية معالجة الإستعلام المالي على ضوء المرسوم التنفيذي الصادر سنة 2022 : بين التراجع والتعزيز

Abstract

تعتبر خاصية الإستقلالية من أهم مميزات السلطات الإدارية المستقلة في مواجهة الهيئات الإدارية التقليدية، غير أن تحول السلطة العامة في الجزائر نحو التراجع عن السلطات الإدارية المستقلة أو ما يعرف بأزمة السلطات الإدارية المستقلة في التشريع الجزائري، أثر بصفة مباشرة على هذه الإستقلالية سواء العضوية أو الوظيفية، في هذه الأثناء صدر المرسوم التنفيذي رقم 22- 36 المؤرخ في 4 جانفي 2022، الذي يحدد مهام خلية معالجة الإستعلام المالي وتنظيمها وسيرها، مع الإحتفاظ لها بوصف السلطة الإدارية المستقلة، فما هو الجديد الذي حمله هذا المرسوم فيما يتعلق بالإستقلالية العضوية لخلية معالجة الإستعلام المالي ما بين تعزيزها أو التراجع عنها. Abstract: The characteristic of independence is one of the most important features of the independent administrative authorities in the face of traditional administrative bodies. However, the transformation of the public authority in Algeria towards a retreat from the independent administrative authorities or what is known as the crisis of independent administrative authorities in the Algerian legislation directly affected this independence, whether membership or functional. In the meantime, Executive Decree No° 22-36 of January 4th, 2022 which determines the functions, organization and processing of the Financial Information Processing Cell. While retaining the description of the independent administrative authority, so what is new with this decree regarding the organic independence of the Financial Inquiry Processing Cell, between strengthening or retracting it.
