التدابير الشرعية والقانونية لحفظ أموال اليتيم في الشريعة الإسلامية والقانون الجزائرية -دراسة مقارنة-

Abstract

"جاءت هذه الدراسة بعنوان: «التدابير الشرعية والقانونية لحفظ أموال اليتيم في الشريعة الإسلامية والقانون الجزائري-دراسة مقارنة-» وعالجت الإشكالية الرئيسية الآتية: فيما تتمثل الأحكام التي أقرّتها الشريعة الإسلامية، واعتمدها القانون الجزائري لحفظ أموال اليتيم؟ أجابت الدراسة على ذلك من خلال ثلاثة مباحث، خُصِّص المبحث الأول للتعريف بمكانة اليتيم، وأمّا المبحث الثاني لأهلية اليتيم وأحكام تصرفاته في ماله، لتُختتم الدراسة بالمبحث الثالث الذي أُفرد لأحكام الولاية المالية على اليتيم، وخرجت بجملة من النتائج أهمّها: درست الشريعة الإسلامية كافة جوانب حياة اليتيم، ووضعت نظاما شاملا متكاملا لحفظ حقوقه المادية والمعنوية، وعمل القانون الجزائري بذلك مع بعض المخالفات، منها ما هو صالح ومنها ما هو غير مُحقق ضمان صلاحه. "This study was titled: This study came under the title:« Sharia and legal measures to preserve orphan’s funds in Islamic law and Algerian law, a comparative study», and addressed the following main problem: What are the provisions approved by Islamic law and the Algerian law to preserve orphan’s funds? The study answered this through three studies. The first topic is devoted to defining the status of an orphan, and as for the second topic for the eligibility of an orphan and the provisions for his disposition in his money, the study is concluded with the third topic that is devoted to the provisions of financial mandate over an orphan, and it came out with a set of results, the most important of which are: Islamic law studied all aspects of life The orphan, and put in place a comprehensive and integrated system to preserve his material and moral rights, and the Algerian law has implemented this with some violations, some of which are valid and some are unfulfilled, to ensure his goodness. "
