إجهاض الجنين المشوه بين الشريعة والقانون: دراسة تأصيلية مقارنة

Abstract

ملخص لقد أحدث التطور العلمي الحادث في المجال الطبي، خاصة في المجال الوراثي وعلم الأجنة طفرة هائلة في العالم بأسره، حيث أنه أصبح بإمكان الطب تصوير الجنين داخل رحم أمه باستعمال الأجهزة الطبية المتطروة، وهو ما يسمح بمعرفة حالة الجنين، وبيان التشوهات الموجودة فيه. وانطلاقا من هذا ظهرت هناك أصوات تنادي بضرورة إجهاض هذا الجنين الذي تظهر فيه تشوهات، والتخلص منه ومن أعبائه قبل خروجه للحياة. لذا جاءت هذه الدراسة لبيان موقف الشريعة الإسلامية، والقانون الجزائري من مسألة إجهاض الجنين المشوه، وقد توصل الباحث من خلال هذه الدراسة إلى أن هذه المسألة قد اختلف فيها بين الباحثين والفقهاء المعاصرين، بين مانع لعملية الإجهاض مطلقا، وبين مجيز لها بضوابط وشروط محددة، ونجد كذلك القانون الجزائري لم يفصل في هذه المسألة، فلا يوجد نص قانوني يمنع أو يجيز إجهاض الجنين المشوه، وتبقى النصوص الموجودة محتلمة لجميع التأويلات والتفسيرات Abstract Medical Technology Development mainly inthe field of genetics and embryology has made a huge breakthrough all around the world. These technological innovations in medicine enable doctors to see the foetus inside the womb of its mother. They alsoallow to know both birth conditions of the fetus and abnormalities. Accordingly, there has been calls for the abortion of this abnormal and deformed foetus, and claims of getting rid of its burdens before it comes to life. The refore, this study came to clarify both Islamic and Algerian law views on the issue of aborting a mutilated foetus. The researcher concluded that there is a controversy about this issue within researchers and contemporary jurists those who strictly prohibited, and others who permitted it with specific controls and conditions. However, the Algerian law has not dealt clearly about this issue; there is no legal provision prohibiting or authorizing the abortion of the mutilated foetus, and the existing texts remain explicable by all interpretations
