مستقبل التمييز بين القانون العام والقانون الخاص

Abstract

يهدف هذا البحث إلى محاولة تحليل معالم الثنائية التقليدية للقانون العام والقانون الخاص في إطار نظرية القانون المعاصرة، وفق الشروط الجديدة التي توفّرها التطوُّرات السياسية، الاقتصادية، الاجتماعية والثقافية الراهنة. ولهذا سوف نقوم بكشف التحوُّلات التي طرأت على مفهوم القانون من المقاربات الدولاتية إلى المقاربات المجتمعية، وذلك من أجل معرفة الترتيبات القانونية الناتجة عن هذه الظروف، والمحدّدة لمميّزات القانون غير الدولاتي، ومنه استخلاص الإطار العام لعملية الضبط القانوني بما يضمن البنية الحالية لمنظومة الحكم في المجتمع. في مقام ثاني، سوف نقوم بتحليل مستقبل التمييز بين القانون العام والقانون الخاص من خلال تفكيك التمييز العام/الخاص، وتفكيك التمييز بين الأبعاد الإجرائية والجوهرية للقانون. Abstract: The aim of this article is to analyze the features of the public/private law dichotomy in the frame of contemporary legal theory, based on the contemporary political, economic, social and cultural transformations. In order to do this, I want to demonstrate the transformations of law from state centered to society centered theories, in order to understand the legal configurations resulting from these conditions, and which define the characteristics of non state law, and to construct the general frame of legal regulation operation in addition to the actual structure of governance system of society. Secondly, I analyze the public/private law dichotomy through the deconstruction of the public/private divide and the procedural and the substantive dimensions of law.
