الفروق التشريعية بين الخطبة والزواج

Abstract

يتمتع عقد الزواج بأهمية بالغة نظرا لمكانته في حياة الإنسان، فمن الضروري التريث في الإقدام عليه بفترة من التفكير، وهي المرحلة التمهيدية تكون في بداية الإقدام على هذا المشروع وما تسمى بالخطبة، ومن أهدافها التأكد من رضا الطرفين ورغبتهم في إتمام هذا العقد من عدمه وأهليتهم لذلك. الخطبة وعد بالزواج، لا تسمو لتصير عقدا بين طرفين، إذ هي مجرد التزام لا ينتج آثرا قضاء كقاعدة، إلا أن يحدث عدول يسبب ضررا لأحد الطرفين، فهنا يجوز التعويض للطرف المتضرر، عكس الزواج الذي يعتبر ميثاقا غليظا وعقدا مقدسا بمجرد إبرامه؛ لا يتم إلا بتوفر عناصر تجسد الأركان فيه والشروط، ليُنتِج آثار ونتائج لكلا الطرفين ولغيرهما. The marriage contract is of great importance due to its position in human life, so it is necessary to wait for a period of reflection, which is the preliminary stage at the beginning of this project and what is called the engagement, and one of its objectives is to ensure the satisfaction of both parties and their desire to complete this contract or not and their eligibility for it. Engagement is a promise of marriage. It does not transcend to become a contract between two parties, as it is just a commitment that does not produce a judicial effect as a rule, unless an alteration occurs that causes harm to one of the parties. Here it is permissible to compensate the aggrieved party, unlike marriage, which is considered a thick pact and a sacred contract once it is concluded; it can only be done by providing elements that embody the elements and conditions in it, to produce effects and results for both parties and others.
