نَمْصُ المرأة -دراسة فقهيّة مقاصديّة معاصرة-

Abstract

هذه الدراسة الموسومة بـــــــ: نـمص المرأة -دراسة فقهية مقاصدية معاصرة- تكمن أهميتها في أنها تتناول موضوعًا يخصُّ زينة المرأة المسلمة، وكان الإشكال الرئيس الذي تسعى للإجابة عليه هو: ما هو حُكم نـَمْصُ حاجبيْ المرأة في الشّريعة الإسلامية؟ وللإجابة على هذا الإشكال وضعتُ خُطّة تضمنت المباحث الآتية: المبحث الأوّل تطرقتُ فيه للحقيقة الشّرعية للنَّمص عُنِيتُ بتعريفه، وبيان موضعه، وما يتعلّق به من مصطلحات ذات صلة. أما المبحث الثّاني سَلّطت فيه الضّوء على الحقيقة الطِّبيّة للنَّمص تعرضتُ فيه لأهمّ وسائل إزالة الشَّعر، وأحدث ما وصلت إليه تقنيات رسم الحواجب، ببيان أحكامها الطبيّة والشّرعية، ثم عرضتُ أقوال الأطباء في المسألة. أما المبحث الثّالث تضمّن الحكم الشَّرعي للنَّمص، بَيّنتُ فيه أقوال الفقهاء في مسألة نـَمص حواجب المرأة، مع عرض لأهم الأدلة والمناقشة والتّرجيح. تَوصّلت الدّراسة إلى جملة من النّتائج لعلّ من أهمها أنّ للنَّمص-بحسب أقوال المختصين- أضرارًا على صحّة المرأة، كما أنَّ العلماء اختلفوا في علّة تحريمه، فذهب بعضهم أنّ العلّة هي تغيير خلق الله، ومنهم من ذهب بأنّ العلّة هي كونه علامة على نساء معيّنات ضعيفات الحصانة، أو علامة للمخنّثين، ومنهم من ذهب إلى كونه أذى، أو ما كان بقصد التّزيّن للأجانب، أو أنّ العلّة هي المبالغة في ترقيق الحواجب. This study is characterized as a title by: "Women's eyebrows plucking" -a contemporary study of the doctrinal jurisprudence- is important in that it deals with the subject of the adornment of the Muslim woman, and the main problem that seeks to answer is: What is the rule of woman's eyebrows plucking in the Islamic Sharia?. To answer this question, a plan is developed that includes the following topics: The first topic deals with the legitimate truth of the eyebrows plucking , its definition, its location, and related terms. The second one sheds light on the medical truth of the eyebrows plucking, in which exposed the most important methods of hair removal, the latest techniques of drawing eyebrows, and the statement of medical and legal provisions, and then presents the doctors' statements on the matter.The third topic includes the Islamic ruling on the eyebrows plucking, and the jurists' statement on the issue of women's eyebrows, with a presentation of the most important evidence, discussion and probability. The study reaches a number of results, perhaps the most important of which is that according to experts, the sneezing damages women's health, and the scholars differed in the cause of its prohibition. Some of them said that the reason is to change the creation of Allah. Some of them are of the view that the illness is a sign of weak women Immunity, or a sign of the bisexual, and some of them go to harm, or is intended to adorn the foreigners, or that the cause is exaggeration in the thinning of the eyebrows.
