Abstract

تهدف هذه الدراسة إلى إلقاء الضوء على ما نعيشه اليوم من تحولات الانتقال إلى مجتمع المعرفة الذي أصبح ضرورة لابد منها من خلال ما تقدمه تكنولوجيا المعلومات والاتصال من إتاحة حرة للمعلومات في ظل التوجه الجديد نحو الولوج الحر للمعلومات بالمقابل التحدي الذي تواجهه حقوق التأليف في البيئة التكنولوجية تحديدا البيئة الرقمية من خلال استقراء النصوص القانونية ومدى ملائمتها للتطبيق في العالم الافتراضي والرؤية الجديدة للموازنة أو الانتقال من حقوق التأليف الفردية إلى عمومية حقوق التأليف من خلال الملكية المشاعة. Abstract This study aims at highlighting what we believe today of transformations transporting us into information society which became a necessity through what information and communication technology offers of free axis to information as part of the new orientation to the free access to information. On the other hand, the challenge the copyrights face in the technological environment, notably digital environment, through the induction of legal texts and their suitability to apply individual work and the new vision of balance or the change from individual copyrights into public-access to copyrights through common property.
