شروط تقرير حقّ المرور على الأملاك المجاورة في القانون الجزائري

Abstract

لحقّ المرور أهمية كبيرة باعتباره حقا قانونيا مقررا لمصلحة مالك الأرض المحصورة للوصول إلى الطريق العام، مقرر بموجب نص المادة 693 من القانون المدني من جهة، كما يعتبر قيدا على من تقرّر على أرضه من جهة أخرى، وهذا ما يستوجب البحث في مدى كفاية قرينة الانحصار لثبوت الحقّ في المرور، أم أن هناك شروطا يجب توفرها من أجل تقرير هذا الحقّ لاعتباره قيدا على حقوق الأملاك المجاورة. فانحصار الأرض عن الطريق العام يعتبر قرينة على ثبوت حقّ المرور بقوة القانون، إلاّ أن هذه القرينة ترتبط بشروط تراعى فيها حقوق الأملاك المجاورين عند اختيار الممر، وعند تعويضهم عن الأضرار التي لحقت بهم. Abstract: The right of way is of great Importance. On the one hand, it is a lawful right for the owner of the enclave to reach the public way according to article 693 of the civil law. On the other hand, it is a restriction for the person whose land is allowed for passage. Therefore, this requires to investigate whether the enclavement evidence is sufficient to prove the right of way or whether there exist other conditions to grant this right which is a restriction on the neighboring properties. The enclavement for the public way is considered as an evidence to prove the right of way by the force of law. Yet this evidence is linked to certain conditions in order to keep the right of the neighboring properties when choosing the passage and their compensation for any damage.
