Abstract

Summary This research includes a study of jurisprudence the familly which is the arbitration between the spouses in Islamic jurispru dence, in order to preserve the familly which is the basic stone on the society. In this resiarch, we relied on the study of jurisprudence, and in particular, we focused on the statements of the four iwams. We divided it into three topics and a conclusion as follows: The first topic: includes the definition of the term arbitration and its ruling by mentioning the sayings of the scholars, and then finally to mention the wisdom of it. The second topic: we assigned it for the rift between the married couples and its definition with mentioning its three causes, and the ways that the husband owns to treat it. The third topic: we outlined in it the conditions of arbitration and we have talked about the conditions that must exist in the two provisions in order in make them do this mission of reforming the spouses or being separated. Conclusion: includes the most important results obtained during this study of jurisprudence.
