قاعدة الإحتياط الفقهي وأثره في فقه الأسرة

Abstract

"هذه الدراسة بعنوان : قاعدة الاحتياط وأثرها في فقه الأسرة، تبحث عن مدى تأثير القاعدة المذكورة في أحكام الأسرة . وعليه بنيت الدراسة على ثلاثة مباحث، حيث تناولت في المبحث التمهيدي التعريف بمصطحات الموضوع، وخصصت المبحث الأول لحجية الاحتياط وأنواعه وشروط العمل به ومقاصده، وأما المبحث الثالث فجعلته لبعض التطبيقات لقاعدة الاحتياط في فقه الأسرة. توصلت الدراسة إلى نتائج أهمها أن قاعدة الاحتياط، أصل تضافرت نصوص الشريعة على اعتبارها والأخذ بها ولا يكاد باب من أبواب الفقه يخلو منها، كما أوصت الدراسة بضرورة اهتمام المفتين بها في زمن كثر فيه التهاون والتهاون في الدين.
