أصول المذهب المالكي عند الإمام البوني في باب المعاملات المالية من خلال كتابه تفسير الموطأ _ نماذج مختارة_

Abstract

تناولت هذه المذكرة موضوع "أصول المذهب المالكي وتطبيقاتها في باب المعاملات المالية للإمام البوني من خلال كتابه تفسير الموطأ ـ نماذج مختارة ـ"، وهو بحث يكشف عن أهمية مكانة البوني ـ رحمه الله ـ عند أهل العلم سواء في المذهب المالكي الذي ينسب إليه أو في غيره من المذاهب وإبراز استدلالاته في مسائل المعاملات المالية، ومن أجل ذلك قسمت بحثي هذا إلى مقدمة وثلاثة مباحث وخاتمة، حيث أشرت في المقدمة إلى أهمية دراسة موضوع المعاملات المالية في وقتنا الحالي، وتناولت في المبحث التمهيدي ترجمة للإمام البوني من حياته ونسبه وشيوخه وتلاميذه وغيرها، وتناولت أيضا في نفس المبحث نبذة عن كتاب تفسير الموطأ للبوني، وتناولت في المبحث الأول الأصول المتفق عليها وتطبيقاتها في المعاملات المالية، حيث ادرجت تطبيقاً واحدا لكل أصل من الأصول (الكتاب، السنة، الإجماع، القياس)، وتناولت في المبحث الثاني الأصول المختلف فيها وتطبيقاتها في المعاملات المالية، حيث اخترت من الأصول ما اشتهر به المالكية (عمل أهل المدينة، المصالح المرسلة، سد الذرائع)، كما أدرجت أيضا تطبيقا واحداً لكل أصل من هاته الأصول، وختمت بحثي بخاتمة تناولت أهم النتائج التي استخلصتها من البحث، وفي الأخير ذيلت البحث بفهارس.
