قاعدة المشقة تجلب التيسير وتطبيقاتها في الفقه المالكي -باب الطهارة أ

Abstract

تناول هذا البحث موضوعا يكتسي أهمية بالغة في الفقه، وقاعدة من كبرى قواعده، وهي قاعدة:(المشقة تجلب التيسير) حيث درس جانبا من تطبيقاا في الفقه المالكي، "باب الطهارة أنموذجا"، وقد أجابت الدراسة على عدة إشكالات أهمها: ما هي المشقة؟ وما هي أقسامها؟ وما أثرها في رفع الحرج التيسير، في باب الطهارة وجلب خاصة؟ . وقد كانت الإجابة ضمن مباحث ثلاثة: فأما الأول: ففيه تعريف للقاعدة الفقهية،وبيان مشروعيتها وتأصيلها، وأما الثاني: فعرف بقاعدة: (المشقة تجلب التيسير)، وذكر بعض القواعد المتفرعة عنها، والمشاق المقتضية للتيسير، أما الثالث: فاحتوى على الجانب التطبيقي للقاعدة، وكانت أهم النتائج المتوصل إليها هي: مدى سماحة الشريعة الإسلامية، ومراعاا لأحوال المكلفين، وقيمة جهود العلماء في إعمال الأحكام والقواعد في أبواب الفقه. Summary This study dealt with a topic of great importance in jurisprudence, and one of its major rules, which is the rule of (hardship to bring facilitation), where he studied some of its applications in the Maliki jurisprudence, "the door of purity is a model." The study answered several problems, What is hardship? What are its divisions? What is its effect in raising the embarrassment of facilitation, in the door of purity and special bring? . The third was: the application of the rule to the rule of law, and the second is the rule of law, The most important findings were: the extent of tolerance of Islamic law, its observance of the conditions of taxpayers, and the value of the efforts of scientists in the implementation of the provisions and rules in the sections of jurisprudence.
