جريمة اختطاف القصر من قبل أحد الوالدين في القانون الجزائري

Abstract

تعتبر الأسرة اللبنة والخلية الأساسية التي يتلقى فيها الفرد تنشئته الأولى ويأخذ منها القيم ومبادئ التربية الصحيحة، إلا أنه يحدث أن تتفكك الأسرة ويصبح الأولاد في تأرجح بين الوالدين ونزاعاتهما حول الحضانة، خاصة حضانة القصر فيدخلون طرفا في تلك النزاعات ويصبحون الطرف المتضرر فيها وقد يقعون عرضة لعدم تسليمهم إلى الجهة المطالبة بهم قانونا وكذا إلى خطفهم وإبعادهم عن من لهم الحق في رعايتهم وحضانتهم وتأمين سلامتهم. لذا وحفاظا على سلامة القصر وحمايتهم من هذه النزاعات و السلوكيات الإجرامية تعمد القوانين الوضعية إلى سن قوانين بهذا الشأن لحمايتهم فكان لزاما علينا تسليط الضوء على هذه الفئة وطرق حمايتها.
