أحكام السمسرة في الفقه المالكي

Abstract

ىذه الدراسة الموسومة ب: أحكام السمسرة في الفقو المالكي, كان الإشكال الرّئيس فيها ىو: ماىي أحكام عقد السمسرة في الفقو المالكي؟ وقد حاولت الدراسة الإجابة على ذلك من خلال مبحثين: مبحث تمهيدي في ماىية عقد السمسرة, وآخر في بيان مختلف أحكامها الفقهية. ففي المبحث الأول تطرقنا لماىية السمسرة, وعنينا فيو بتعريفها, وذكر الألفاظ ذات الصلة بها, وبيان مشروعيتها في المذىب المالكي, وتكييفها الفقهي وعلاقتها بالعقود المالية الأخرى, وأركانها وشروطها. وأما المبحث الثاني فيتضمن الأحكام الفقهية لعقد السمسرة, وعنينا فيو بجمع مسائلو الفقهية من خلال المذىب المالكي; وذلك فيما يتعلق بصيغتو, وعاقديو, وما يتعلق بعمل السمسار وأجرتو, وأسباب انتهاء ىذا العقد وفسخو. توصلت الدراسة إلى جملة من النتائج لعل من أهمها أنَّ أحكام عقد السمسرة لا تندرج ضمن عقد واحد من العقود ا ولمعاملات المالية, وإنما تبنى على حسب تكييفها وحالاتها وصفة العقد في كل حالة, وعلى ما شابهها من الأحكام في أبواب الإجارة والجعالة وغيرىا من العقود, كما أوصت الدراسة بضرورة إدراج عقد السمسرة ضمن الموسوعات والمصنفات الفقهية العامة تحت باب خاص بو مثلو مثل عقد البيع والإجارة وغيرىا من العقود المالية; حتى يسهل الرجوع إليو من طرف الباحثين والمهتمين وطلبة العلم. A summary The study tagged with: the provisions of the commission in al-Maliki doctrine, the main problem in which is , What are the provisions of the commission contract in al-Maliki doctrine? The study tried to answer through two sections: Study of a preliminary nature of the brokerage contract, and another in the various provisions of the doctrinal statement. In the first search, we mentioned the essence of commission ,we meant its definition, and thetrems linked to it, and its ligitimacy in Al-mality doctrine, its doctrinal conditioning with and its relationship in the financial contracts. As for the second search, it includes the juristic rules the brokerage contract, we meant the gathering the juristic issues in Al- Maliki doctrine , concerning its formula, its contract, and concerning the commissioner work, his pay and the reasons for ending this contract and its repealing. The study reached a number of results. Perhaps the most important of these is that the provisions of the brokering contract do not fall under one contract of financial contracts and transactions. Rather, they are based on their adaptations and cases, the description of the contract in each case and the similar provisions in the sections of Ijara and Ja'ala and other contracts. Studying the necessity of listing the brokering contract within the general legal encyclopedias and works under a special section such as the contract of sale, leasing and other financial contracts; So that it is easy to refer to it by researchers, interested and students of knowledge.
