جريمة خيانة الأمانة - دراسة مقارنة بين الشريعة والقانون

Abstract

المذكرة الضوء على جريمة خيانة الأمانة والتكييف الفقهي والقانوني هذه الجريمة لأىمية ىذا الموضوع، واعتمدت لدراسة ىذا الموضوع المنيج الوصفي والتحميمي إضافة إلى المنيج المقارن. حيث تناولت في الفصل الأول مفيوم جريمة خيانة الأمانة من خلال تعريف الجريمة والخيانة والأمانة والمفظ المركب بينيا " جريمة خيانة الأمانة "وشروط قيام ىذه الجريمة ، وكذلك التمييز بينيا وبين الجرائم المشابية ليا كالسرقة والنصب والاختلاس، ثم وضحت الجرائم الممحقة بجريمة خيانة الأمانة وىي خيانة الأمانة في التوقيع عمى بياض ،وسرقة المستندات المقدمة لممحكمة ،وجريمة استغلال القصر. أما الفصل الثاني فتطرقت فيو لأركان الجريمة من الجانب الشرعي والقانوني ببيان نصوصيا الشرعية والقانونية وصورىا، وعرضت فيو العقوبات المقررة ليا في الشريعة والقانون الجزائري مع بيان عقوبة الجريمة في حال وجود ظروف مشددة.ABSTRACT Receipt of this note highlights the crime of dishonesty and air conditioning Method and legal framework for this crime to the importance of this subject , and adopted for the study of this subject the descriptive and analytical as well as the comparative method .
