الجهود الدولية والداخلية لمكافحة خطاب الكراهية - دراسة مقارنة بالفقه الاسلامي-

Abstract

"ملخص الدراسة: تناولت هذه الدراسة جريمة خطاب الكراهية في التشريعات الدولية وفي التشريع الجزائري والفقه الإسلامي، حيث تم من خلالها تسليط الضوء على أهم الاتفاقيات الدولية والوطنية والمواثيق التي عالجت هذه الظاهرة، والجهود المبذولة للتصدي لخطاب الكراهية والوقاية منه من جهة، ومن جهة ثانية كيف عالج الإسلام خطاب الكراهية بدءًا من البحث في أسباب الكراهية والعوامل المساعدة على انتشارها، مع تبيان منهج الإسلام في مجابهتها.

لقد أفضت هذه الدراسة إلى مقارنة بين القانون الوضعي والفقه الإسلامي في الجهود المبذولة لمجابهة خطاب الكراهية والوقاية منه، والقضاء عليه بشتى السبل، وخلصت الدراسة أن الشريعة الإسلامية صاحبة السبق في مكافحة خطاب الكراهية لأنها أول شريعة تؤكد على وجوب احترام الكرامة البشرية الذي يركز خطاب الكراهية على الحط منها. ""Abstract: This study dealt with the crime of hate speech in international legislation and in Algerian legislation and Islamic jurisprudence, through which the most important international and national conventions and covenants that dealt with this phenomenon were highlighted, and the efforts made to address and prevent hate speech on the one hand, and on the other hand how Islam dealt with hate speech Starting with researching the causes of hatred and the factors contributing to its spread, with an explanation of the Islamic approach to confronting it. This study led to a comparison between positive law and Islamic jurisprudence in the efforts and means provided to refute hate speech, prevent it, and eliminate it by various means. The study concluded that the Islamic law takes precedence in combating hate speech because it is the first law that affirms the necessity of respecting human dignity, which focuses hate speech on degrading it.
