صلاحيات الحاكم وواجباته في إدارة الأزمات الصحية في السياسة الشرعية: جائحة كورونا أنموذجا

Abstract

ملخص باللغة العربية يهدف هذا البحث إلى بيان ما يتمتع به الحاكم في النظرية الإسلامية من قواعد مرنة وصلاحيات واسعة، تحفظ كيان الدولة والمجتمع عند ظهور الأزمات ومنها أزمة جائحة كورونا؛ لأن منطلقه الشريعة وهي غذاء وشفاء ورحمة للعالمين. كذلك يصبو الباحث إلى إزالة التناقض الذي يظهر -عند البعض- بين السياسة (العادلة) والدين (الحق)؛ لأن أصلهما واحد ويصدران من مشكاة واحدة، وبيان أن في النظام الإسلامي علم شريف يربط بينهما في تناغم تام -كما هو الحال في مسألتنا هذه- هو علم السياسة الشرعية. وكان من أهم نتائج البحث اعتبار وباء كورونا نازلة جديدة، وعليه فلولي الأمر اتخاذ أوامر وإجراءات غير معهودة في فقه وتاريخ المسلمين مع التقيد بالمصلحة الشرعية، وتم التمييز بوضوح بين البعدين العقائدي والسياسي الشرعي في الأوبئة عموما وجائحة كورونا خصوصا، وقد كان هذا الأمر غامضا ومختلطا في تراثنا الفقهي وكان سببا في اختلاف آراء الفقهاء منذ عهد الصحابة إلى اليوم بسبب عديد الأحاديث النبوية الشريفة الواردة في الأوبئة والتي كانت متعارضة في الظاهر. Abstract This research aims to demonstrate the flexible rules and broad powers that the ruler enjoys in Islamic theory, which preserve the entity of the state and society when crises arise, including the crisis of the Corona pandemic. The researcher also aspires to remove the contradiction that appears - for some - between politics (just) and religion (the truth), and to show that in the Islamic system there is an honorable science that links them in perfect harmony - as is the case in our issue - which is the science of legitimate politics. One of the most important results of the research was considering the Corona epidemic as a new outbreak, and therefore the guardian must take orders and procedures that are unusual in the jurisprudence and history of Muslims while adhering to the legitimate interest, and a clear distinction was made between the legal ideological and political dimensions in epidemics in general and the Corona pandemic in particular.
