حرية التعبير -من منظور المشرع الجزائري والشريعة الإسلامية

Abstract

تعتبر حرية التعبير مطلبا وحقا بالنسبة للأفراد، وهي بالمقابل واجب على عاتق كل مسؤول، وحرية التعبير لا تقتصر على مجال معين فحسب، بل تمتد إلى كافة المجالات، لذلك وجب الحفاظ عليها وضمان بقاءها، الأمر الذي دفعنا إلى دراستها دراسة مقارنة بين الشريعة الإسلامية والتشريع الجزائري، بغية الوصول إلى أي مدى كفلت النصوص الشرعية والقوانين الجزائرية هاته الحرية، بالإضافة إلى مع رفة الضمانات التي تحفظ استمرارهاFreedom of Speech is an absolute right for people and in the opposite angle is a duty for any responsible . As a matter of fact the freedom of speech is not limited to one side of life but it is versatile and different and cover all parts of life. That’s why should individuals preserve it and keep it alive. In this current study we are addressing this issue deeply through a comparison study between Islamic law and Algerian Constitution in order to figure out in what extent these laws fully guarantee this rights besides the guarantees that keep its continuity .
