الانتحار دراسة مقارنة بين الشريعة الإسلامية والقوانين الوضعية )الجزائر- فرنسا

Abstract

تمقي ىذه المذكرة الضوء عمى المسؤولية الجنائية لممنتحر، والتكييف الفقيي والقانوني لجريمة الانتحار نظ ا رً لكثرة انتشار ىذه الظاىرة في ىذا العصر. وعميو تحدثت في الفصل الأول عن المسؤولية الجنائية، حيث توصمت إلى أن ىذه المسؤولية تقوم عمى أساس وجود فعل محرم وعمى الإد ا رك والاختيار، كما يجب أن يتمتع الجاني بأىمية كاممة مع الإ ا ردة ، وأضاف القانون مسألة الغمط، بالإضافة إلى الأحكام المتعمقة بالانتحار والمنتحر، وىو نوعان انتحار سمبي وايجابي؛ وكلاىما محرم شرعاً، كما أن لممنتحر حق في التجييز والدفن. أما الفصل ، بالإضافة إلى وسائمو وأسبابو، التي من أبرزىا البعد عن منيج الرسول الثاني فتطرقت فيو إلى صورتي الانتحار: القتل الرحيم والعمميات الاستشيادية التي أجازىا الفقياء بشروط، وبالنسبة لممبحث الثاني فيو يشمل كل من عقوبة الشروع والتحريض عمى الانتحار، ووجدت أن لمشروع ثلاثة صور: الجريمة الموقوفة، الخائبة والمستحيمة ...This memory highlights on the criminal responsibility of the suicide doer (person who commits suicide)in addion to the Islamic and legal adaptation of the suicide as a wide spreaded phenomen. The first chapter depends on the criminal responsability where I deduced that this responsability bases on, the presence of an act prohibited from a perceptive and voluntary angles, wrong doer must also be in his full legal competence, the law has also added the fault process, and the judgments depending about the suicide and its roes (committed one). It has also two faces: positive and negative one as well as thee right of the suicide doer in expulsion and inhumation(burying). Te discussed its means and causes. as a result of going astray to the way of prophetic sunna. In the second chapter, I discussed the suicide crime from its both sides: mercy killing and martyrdom operations which are authorised , but with some conditions by Foqaha( Islamic scholar ),this chapter contains also the pusishments of the attempt and the instigation to suicide. I found also that suicide attempt has three faces, Stopped crime, missed crime, and the impossible one.
