Abstract

إن التدخّل الطّبّي من المواضيع التي اهتمّت بها الشّريعة الإسلامية وذلك لما ورد من نصوص شرعية من القرآن الكريم أو من السنّة النّبوية، بمعنى العموم، فتنظّم ضوابطه وشروطه فحتّى قديما نجد الفقهاء تكلّموا في هاته المسألة وفي نفس الوقت نجد القانون الطّبّي الجزائريّ ،يقرّ لها أحكاما ونصوصاً قانونية، فالمشرعّ الجزائريّ وضع لها ضوابط وشروط تحكمه وذلك لحماية الأفراد والمجتمعات من خلال وضع هاته النّصوص القانونية في الجريدة الرسمية في قانونين سابقين، أحدهما قديم والآخر حديث وذلك، مرورا بالمرسوم التنفيذي المؤطّر لأحكام التدخّل الطّبّي وتقرير عقوبات صارمة لمن يقوم بالمخالفة أثناء هذه العمليات والتي تعرف بعمليتي التّشريح ونقل وزرع الأعضاء البشرية وتبقى مضبوطة بقيود فقهية في الفقه الإسلامي أو بقيود قانونية في القانون الطّبّي الجزائريّ."Absatract Medical intervention is one of the topics that Islamic law has focused on، due to the legal texts mentioned in the Holy Quran or the Sunnah of the Prophet، meaning in general terms، regulating its controls and conditions. Even in ancient times، we find jurists speaking about this issue، and at the same time، we find Algerian medical law establishing legal provisions and texts for it.
