Abstract

يعالج البحث أحد القواعد الفقهية ، وهي قاعدة " درء المفاسد أولى من جلب المصالح " وتطبيقاتها الطبية ، وقد حاولت الدراسة الإجابة على عدة إشكالات أهمها : المقصود بقاعدة درء المفاسد أولى من جلب المصالح ، وكذلك التطبيقات الطبية لهذه القاعدة وذلك من خلال تقسيم الدراسة إلى مبحثين ،الأول : تضمن معنى قاعدة درء المفاسد أولى من جلب المصالح ، بداية بمعناها ، ثم أدلتها ،وأهميتها وشروط إعمالها ، إلى مجال تطبيقها أما الثاني :فقد تناول تطبيقات القاعدة بدراسة خمس مسائل طبية ، أولها جراحة تغيير الجنس ، ثم إجهاض الجنين المشوه بعد نفخ الروح ، يليها الاستنساخ البشري العادي ، ثم بنوك الأجنة ، وآخرها الرتق العذري ، وختمت البحث بخاتمة بينت فيها أهم النتائج والتوصيات التي توصلت إليها .
