Abstract

ملخص: تشكل بورصة القيم المنقولة اليوم الميدان الخصب للاستثمار حيث يتم تداول مختلف الأوراق المالية مما تعكس صورة التطور الاقتصادي لأي دولة وتبيّن مدى نجاعة استثمارها ،ويلعب الوسيط الدور الأبرز في هذه السوق حيث يعتبر أساس قيامها لكونه محور عملية التداول ،فهو حلقة الوصل بين العملاء بيعاً وشراءً ،إذ لا تتمّ مختلف الصفقات البورصية إلا بوساطته ،ولأهميّة هذا الدور وخطورته في الوقت نفسه فقد اهتمت مختلف التشريعات بتنظيم ومراقبة نشاطه وأحاطته بضوابط كان لها الأثر على الطبيعة التعاقدية بينه وبين عملائه والمتدخلين في هذه السوق. Abstract: stock exchange represents a fertile soil for investment where stock of various types are traded, this practice leades to development of any given country and showcases the effectiveness of its investment. The broker plays the most prominent role in this market .Brokers represent the link for this trading process, the various transactions of stock markets are only through broker's mediation. Because of this importance and seriousness, various legislations have been formulated to organize and control this activity, surrounding it with regulation that shape contractual nature between the different stakeholders in this market.
