قراءة في القانون التونسي للمؤسسات الناشئة، من أجل إصدار قانون جزائري ناجع لها

Abstract

تُعدُّ التجربة التونسية رائدة في مجال المؤسسات الناشئة مقارنة ببقية دول المغرب العربي؛ حيث تعتبر من أهم مكونات النسيج الاقتصادي، ولأجل ذلك أصدر المشرع التونسي سنة 2018 قانونًا خاصًا بها. في مقابل ذلك تبنت الجزائر سياسة جديدة موجهة نحو الاهتمام بالمؤسسات الناشئة؛ وذلك لما لهذه الأخيرة من خصوصيات ومميزات تؤهلها لتحقيق الإقلاع الاقتصادي، لكن تزامن ذلك مع غياب نص قانوني يؤطرها ويسمح لها بتحقيق الأهداف المنتظرة منها، والمتعلقة بالتنمية. وقد جاءت هذه الدراسة لإبراز أهم محاور القانون التونسي للمؤسسات الناشئة، مع القيام بإسقاطها على ملامح القانون الجزائري المنتظر ليكون أكثر نجاعة. The Tunisian experience is considered to be a pioneer in the start-ups, especially in comparison with the rest of the Arab Maghreb counties. Due to the important role of the start-ups in the economic fabric. For that the Tunisian legislator issued in 2018 a special law about it. On the other hand, Algeria adopted a new policy directed towards being more interested with the emerging institutions or the start-ups, because of the peculiarities and advantages of the latter to achieve the desired economic take-off. However, this approach is coincided with the absence of legal texts that frame this type of institutions and allow it to achieve its development goals. Through this study, we are trying to highlight the most important themes in Tunisian law about the start-ups, with an attempt to bring it down on the features of the expected Algerian law.
