Abstract

لضحايا في التعويض مكفول بموجب القانون الدولي والوطنيوالتشريعات الداخلية،وفي البلدان الخارجة من النزاعّ، تعدالعدالة التعويضية واحدة من أكثر آليات العدالة الانتقالية ارتباطًا بضحايا الانتهاكات الجسيمة للقانون الدولي لحقوق الإنسان والقانون الإنساني الدولي، ونظرا لتأثيرها المباشر على الضحايا،أصبحت الآلية الأكثر تطبيقا على المستوى الوطني من خلال برامج جبر الضرر، وتتنوع أشكالها حسب طبيعة الانتهاكات والمتأثرين بها، ملتزمة في ذلك بمعايير القانون الدولي. The right of victims to compensation is guaranteed by international and national law, and domestic law. In post-conflict countries, compensatory justice is one of the transitional justice mechanisms that are most closely linked to victims of gross violations of international law of human rights and international humanitarian law. Due to its direct impact on victims, it has become the most applicable mechanism at the national level through reparation programs, its types vary according to the nature of the violations, and the people affected, abiding in that the criteria of the international law
